When responses to negative online reviews can create legal risks

A harsh review can feel personal, especially when it questions your professional care. That reaction may create an understandable urge to correct the account. Yet a quick public reply can carry legal risks.

As a dentist, you may benefit from understanding how defending your work could cross privacy and evidence rules. Knowing these limits can protect your practice and patients.

Even an accurate reply may reveal confidential facts. Consider these possible consequences before answering criticism online.

A reply can disclose protected health information

Federal privacy rules generally bar your practice from revealing protected health information without authorization. This duty often remains when a patient discusses treatment first.

Suppose a reviewer claims you recommended an unnecessary root canal. You reply that the person refused X-rays and missed appointments. Those details could identify the reviewer as your patient. Confirming that the person received care may also expose protected information.

In one case, a dental practice disclosed such data while answering a negative review. Federal officials imposed a $50,000 civil penalty.

A disclosure can prompt professional discipline

New York may treat the unauthorized release of confidential patient information as professional misconduct. If regulators make that finding, they could issue a reprimand or fine. They might also restrict, suspend or revoke your license.

Your statements can become malpractice evidence

An angry exchange does not always prove negligent care. However, a patient’s attorney could compare your words with charts and sworn testimony.

Imagine writing, “We warned you that the swelling was serious.” That wording might show that you knew about a developing problem. If relevant, your comment could qualify as a party admission. Counsel would also need to authenticate it. A contradiction might further weaken your credibility.

A defamation case can widen the dispute

False factual claims sometimes support a defamation action. Opinions usually receive greater protection.

In New York, the anti-SLAPP law may apply to a claim based on a public review. The post must involve an issue of public interest. If the law applies, the claimant must present clear and convincing evidence. That proof must show that the speaker knew a material statement was false or recklessly disregarded its truth.

A restrained reply reduces avoidable exposure

You can generally ask the reviewer to contact your office privately. Do not confirm any patient relationship. Avoid treatment facts, billing details, threats and insults. If you reasonably anticipate a claim, preserve relevant posts. Deleting them may raise separate evidence concerns.

Careful judgment before responding

Before posting, consider how your words would look beside the dental chart or in court. Pausing can give you time to save the review and check the patient’s record.

If the post alleges an injury or threatens a claim, that initial assessment may also reveal the need for legal guidance. An attorney can assess confidentiality duties, evidence-preservation needs and risks within a proposed response.
